{"id":1143157,"date":"2026-01-08T18:31:42","date_gmt":"2026-01-08T13:31:42","guid":{"rendered":"https:\/\/www.app.com.pk\/?p=1143157"},"modified":"2026-01-08T18:31:42","modified_gmt":"2026-01-08T13:31:42","slug":"eobi-pensioners-no-circular-can-restrict-parliamentary-law-rules-fccp","status":"publish","type":"post","link":"https:\/\/demo.app.com.pk\/index.php\/2026\/01\/08\/eobi-pensioners-no-circular-can-restrict-parliamentary-law-rules-fccp\/","title":{"rendered":"EOBI pensioners: No circular can restrict parliamentary law, rules FCCP"},"content":{"rendered":"<div>ISLAMABAD, Jan 08 (APP):The Federal Constitutional Court of Pakistan has held that no administrative circular can override or limit a law passed by Parliament or any of its schedules.<\/div>\n<div><\/div>\n<div>The ruling came in a significant decision concerning the Employees\u2019 Old-Age Benefits Institution (EOBI), marking a major development in pension rights for thousands of workers.<\/div>\n<div><\/div>\n<div>A three-member bench headed by Chief Justice Aminuddin Khan, and comprising Justice Syed Hasan Azhar Rizvi and Justice Arshad Hussain Shah, delivered the verdict while dismissing multiple appeals filed by EOBI.<\/div>\n<div><\/div>\n<div>The Court upheld earlier judgments of the Lahore High Court.<\/div>\n<div><\/div>\n<div>In its decision, the Court ruled that employees who have completed 14 years and 6 months or more of insurable employment are entitled to monthly old-age pension. It held that under the schedule attached to the Employees\u2019 Old-Age Benefits Act, 1976, any period of insurable employment of six months or more must be counted as a full year, and this principle applies to pension eligibility as well as pension calculation.<\/div>\n<div><\/div>\n<div>The Court emphasized that EOBI is a welfare institution and welfare laws must be interpreted in favor of employees. Denying a lifelong pension due to a shortfall of a few months, it said, violates justice and constitutional principles.<\/div>\n<div><\/div>\n<div>The bench declared the EOBI circular issued in 2022 ineffective, noting that administrative instructions cannot curtail statutory rights.
